3. User Account

3.1. You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account.

4. User Obligations

4.1. You agree to use the Service only for lawful purposes and in accordance with these Terms.

4.2. You must not use the Service in any way that causes, or may cause, damage to the Service or impairment of the availability or accessibility of the Service.

4.3. You must not use the Service in any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

5. Payment Terms

5.1. ContentPeak offers subscription-based access to the Service. The minimum subscription period is monthly.

5.2. Fees are charged in Euros (EUR). Payment is accepted via credit card.

5.3. We do not offer a free trial of the Service.

5.4. Custom pricing is available for enterprise customers. Please contact our sales team for more information.

5.5. You agree to pay all fees associated with your use of the Service. Fees are non-refundable except as expressly provided in these Terms.

5.6. In case of cancellation, we offer prorated refunds for the unused portion of your subscription.

6. Data Handling and Privacy

6.1. We store customer data on our servers. We do not share customer data with third parties.

6.2. Upon termination of your account, we retain your data for 90 days, after which it will be deleted.

6.4. We maintain a separate Privacy Policy that describes our practices regarding the collection, use, and disclosure of your information. By using the Service, you also agree to our Privacy Policy.

7. Intellectual Property Rights

7.2. You may view, download, and print content from the Service for your own personal and internal business use, subject to the restrictions set out in these Terms.

7.3. You must not use any part of the content on the Service for commercial purposes without obtaining a license to do so from us or our licensors.

8. Limitation of Liability

8.1. ContentPeak provides the Service "as is" and "as available" without any warranties, either express or implied.

8.2. To the fullest extent permitted by applicable law, ContentPeak shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

a) Your use or inability to use the Service;

b) Any unauthorized access to or use of our servers and/or any personal information stored therein;

c) Any interruption or cessation of transmission to or from the Service;

d) Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.

9. Service Level Agreement (SLA)

9.1. ContentPeak offers a Service Level Agreement (SLA) with an uptime guarantee of 99.9%.

9.2. Details of the SLA, including any service credits for failure to meet the uptime guarantee, are provided in a separate document.

10. Termination

10.1. You may cancel your subscription and terminate these Terms at any time by contacting our customer support team.

10.2. ContentPeak may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10.3. Upon termination, your right to use the Service will immediately cease.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Germany. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes to these Terms, we will provide notice of such changes by updating the date at the top of these Terms and by maintaining a current version of the Terms on this page. Your continued use of the Service after any such changes shall constitute your consent to such changes.
